For the same reason you can do anything else. Practically everything you can do on a computer is "patented."

As anyone can see, Arc is covered by Artistic License 2.0 http://www.perlfoundation.org/artistic_license_2_0 MzScheme is covered by GNU Lesser General Public License (LGPL). http://www.gnu.org/licenses/lgpl.html

What do you mean by 'patented' and why worry?
